By accessing or using Convoboost (the "Service"), a product of Gagahealth Private Limited ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
The Service is a software tool that allows users to automatically reply to comments and direct messages on their Instagram account(s). You understand and agree that the Service is provided "AS-IS" and "AS-AVAILABLE" and is dependent on the availability and policies of the Instagram platform.
You agree not to use the Service to violate any law, violate the terms of service of Instagram, engage in any fraudulent activity, or attempt to reverse engineer the Service.
If you subscribe to a paid plan, you agree to pay the fees specified for that plan. All fees are billed in advance on a recurring basis and are non-refundable, except as required by law. Payments are handled by a third-party payment processor.
We own all rights, titles, and interests in and to the Service, including all related software, logos, and trademarks. You own all rights to the content you create and send using the Service ("User Content"). You grant us a limited, worldwide, non-exclusive license to access, use, and process your User Content solely for the purpose of providing the Service to you.
You can terminate your account at any time by stopping your subscription and disconnecting the service. We may suspend or terminate your access to the Service at any time, with or without cause, for any reason, including, but not limited to, a breach of these Terms.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GAGAHEALTH PRIVATE LIMITED MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAGAHEALTH PRIVATE LIMITED, ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless Gagahealth Private Limited and its employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service or your violation of these Terms.
These Terms shall be governed and construed in accordance with the laws of India. You agree to submit to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India to resolve any legal matter arising from the Terms.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on our website at https://convoboost.in/terms.html.
